Draft pending legal review. Written against Swiss law and intended as a starting point. It should be reviewed by qualified counsel before being relied upon.

These terms govern your use of blacalp.com. By using the site you accept them. If you do not accept them, please do not use the site.

1. Who we are

The site is operated by Blacalp, Konkordiastrasse 20, 8032 Zurich, Switzerland. Contact: info@blacalp.com.

[REVIEW] Add the registered legal entity name, legal form and commercial register (CHE) number.

2. Use of the site

You may view and use this site for lawful purposes connected with evaluating or engaging our services. You agree not to:

3. Content is information, not advice

Everything on this site — including the Growth Diagnostic, case studies, frameworks and articles — is provided for general information. It does not constitute business, legal, financial or investment advice, and does not create a consultant–client relationship.

The Growth Diagnostic produces an indicative result based only on the answers you provide. It is not a validated assessment of your business and should not be used as the sole basis for any decision.

4. Case studies and results

Case studies describe past engagements. Figures are specific to those clients and their circumstances. They are illustrative and are not a promise, guarantee or prediction of results for any other business.

Where a client is named, it is with permission. Where an engagement is described without naming the client, identifying details may have been altered to protect confidentiality.

5. Intellectual property

The content, design, structure, frameworks and marks on this site — including the Blacalp name, the 5D GTM Operating System and the AI GTM OS — are owned by Blacalp or used with permission, and are protected by intellectual property law.

You may read, print and share individual pages for your own internal, non-commercial evaluation. Any other reproduction, adaptation, distribution or commercial use requires our prior written permission.

6. Information you submit

You confirm that information you submit is accurate and that you are entitled to provide it. Personal data is handled as described in our Privacy Policy.

Please do not send confidential or sensitive information through the site's forms. Contact us to arrange a secure channel instead.

7. Availability

We aim to keep the site available but do not guarantee uninterrupted access. We may change, suspend or withdraw any part of it at any time without notice.

8. Third-party links

The site may link to third-party websites. We do not control them and are not responsible for their content, availability or practices. A link is not an endorsement.

9. Liability

To the fullest extent permitted by Swiss law, Blacalp is not liable for indirect or consequential loss, loss of profit, loss of business or loss of data arising from use of, or inability to use, this site or reliance on its content.

Nothing in these terms excludes liability that cannot be excluded by law, including liability for unlawful intent or gross negligence.

[REVIEW] Confirm the limitation of liability is enforceable as drafted, particularly for consumers and EU visitors.

10. Changes to these terms

We may revise these terms. The version published here at the time you use the site is the version that applies. The date at the top shows when it was last revised.
